Party Square - Our Terms and Conditions

By utilizing the Partysquare.in Platform (the "Website") or engaging our services, you (the "Client/Customer") acknowledge and agree to the following legally binding Service Agreement.
1. Service Engagement & Scope of Work
1.1 Service Description - Party Square specializes in premier event planning, custom theme installations, and coordination of professional entertainment (artists, performers). We execute concepts using our dedicated team and carefully vetted network of specialists.
1.2 Age Requirement - You must be 18 years of age or older to enter into a service contract with Party Square.
1.3 Communication Protocol - By confirming a booking, you grant permission to receive essential, promotional/non-promotional messages (SMS, WhatsApp, Email) necessary for order verification, coordination, and feedback.
2. Financial Terms and Order Management
2.1 Quote Validity - Custom price quotations are issued under our Transparent Pricing commitment and remain valid for a period of 10 days from the date of issuance.
2.2 Advance Payment - A Deposit of 30% of the total value is required to reserve the date and initiate material procurement/design finalization. The service date is not secured until this deposit is successfully processed.
2.3 Final Balance & Completion Payment - The remaining payment balance is due on the day of the event, upon successful completion of the setup/service by the Party Square team and before the event commences. The Client must remit the full outstanding amount immediately upon sign-off that the service is completed as per the Service Order. Failure to remit payment after service completion may result in the immediate suspension or withdrawal of any staffed services (e.g., performers, artists) and legal action to recover costs.
2.4 Payment Security - Payments are processed exclusively via secure, PCI-compliant payment gateways. We do not store or access your personal card, bank, or UPI credentials.
2.5 Policy Hierarchy - Where applicable, bespoke terms for cancellation and rescheduling are detailed directly on the individual product or service description page. If a specific product or service listed on the Website has a unique cancellation/rescheduling policy, that specific policy shall supersede the general policy outlined below.
3. Cancellation, Postponement, and Remittance Schedule
More than 48 Hours Before Event: You are eligible for a 90% refund of the total order value.
24 Hours to 48 Hours Before Event: You will receive a 60% refund of the total order value.
20 Hours to 24 Hours Before Event: You are eligible for a 50% refund of the total order value.
Less than 20 Hours Before Event: No Refund is issued for the total order value.
Non-Refundable Scenarios: Refunds are not issued for custom-printed items, personalized gifts, or when the execution team has already dispatched for On-Time Execution.
Postponement: Event date changes are subject to availability and the date of the event.
4. Site Access and Execution Responsibility
4.1 Site Condition - The Client must provide safe, clear, and unencumbered access to the venue for the setup team at the agreed-upon time. Delays caused by venue restrictions or lack of access are the sole responsibility of the Client.
4.2 Decor Longevity - Our setups are optimized for the event duration. Party Square provides reasonable usage lifespan expectations for perishable items (e.g., flowers, balloons) but cannot guarantee durability beyond the event due to uncontrolled environmental factors (A/C, airflow, sunlight).
4.3 Surface Integrity - We employ standard, removable adhesives. Party Square disclaims responsibility for any minor paint peeling, surface damage, or wallpaper tearing caused by existing surface fragility or previously compromised walls, which is inherent to applying temporary decor.
5. Rental Items and Liability
5.1 Rental Custody - Certain items (e.g., custom backdrops, metal stands, LED/Neon signage, high-value props) are provided on a temporary rental basis. The Client assumes full custodial responsibility for these items immediately upon successful installation sign-off.
5.2 Damage and Loss - The Client is financially liable for the full replacement cost of any rental items that are lost, stolen, or returned damaged or vandalized. This fee will be invoiced separately post-event.
5.3 Collection - The Client must ensure rental items are ready for the designated pickup team within 24 hours of event completion. Failure to facilitate timely collection may incur extended rental charges.
6. Partner Screening and Indemnity
6.1 Screening and Coordination - Party Square coordinates services with screened specialists (artists, staff, helpers, decorators, entertainers). Our role is facilitation, we are not the direct employer of external service partners.
6.2 Venue/Food Disclaimer - For bookings involving catering or venue-provided services, Party Square is expressly not liable for food allergies, food poisoning, service quality issues, or any claims relating to the venue's infrastructure, staff, or cleanliness. Such issues must be raised directly with the venue management.
6.3 Non-Solicitation - The Client agrees not to directly hire or contract any Party Square staff, decorators, or artists for private events outside this Platform for a period of 12 months following the event. Any breach of this provision shall constitute grounds for injunctive relief and the initiation of legal action, seeking reimbursement for all damages, including but not limited to, lost revenue and associated costs.
6.4 Indemnification - The Client agrees to indemnify and hold Party Square, its employees, and partners harmless from any claims, fines, liabilities, or losses arising from: Client/Guest misconduct, unsafe venue conditions, or damage/injury resulting from tampering with the installed decor.
7. Force Majeure - Neither Party shall be held responsible or liable for any failure or delay in fulfilling its contractual obligations (excluding payment obligations for services already rendered) when such failure or delay is caused by an Event of Force Majeure. Such events include, but are not limited to: severe weather events, natural disasters, acts of God, public health emergencies (e.g., pandemics), accidents, acts of terrorism, war, civil unrest, or any government-imposed restrictions, lockdowns, or actions that make performance commercially impracticable or impossible.
8. Governing Law and Intellectual Property
Intellectual Property (IP): All concepts, templates, images, and content displayed on the Platform are the protected property of Party Square. Unauthorized reproduction for commercial gain is strictly prohibited.
Dispute Resolution: This Agreement is governed by the laws of India. Disputes shall be subject exclusively to the jurisdiction of the Courts in Bangalore, Karnataka, India.
